Welcome to Tiny Sleeps. Please read these Terms and Conditions ("Terms") carefully before using the Tiny Sleeps mobile application ("App") operated by Tiny Sleeps ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Tiny Sleeps is a baby sleep, feeding, and diaper tracking application designed to help parents and caregivers monitor their infant's daily routines. The App provides:

• Sleep session tracking and wake window calculations
• Feeding and diaper change logging
• Pattern analysis and insights
• Optional data sharing with sleep consultants
• Cloud synchronization across devices

2. Medical Disclaimer

• The App provides informational guidance only and should not replace professional medical advice
• Always consult with your pediatrician or healthcare provider for medical decisions regarding your child
• Sleep recommendations are general guidelines based on age ranges and may not be appropriate for every child
• If you have concerns about your child's sleep, feeding, or health, seek professional medical advice immediately

3. User Accounts

3.1 Account Creation

To use certain features of the App, you may need to create an account using Apple Sign In or other authentication methods. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App settings, which will permanently remove your data from our servers.

4. Privacy and Data Collection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

4.1 Data We Collect

• Baby profile information (name, birth date)
• Sleep, feeding, and diaper tracking data
• Device information for app functionality
• Account authentication data

4.2 Data Storage

• Data is stored securely in the cloud using industry-standard encryption
• You can export your data at any time
• You can request deletion of all your data through the App or by contacting us

4.3 Data Sharing

• We do not sell your personal data
• You may optionally share data with sleep consultants using secure, time-limited share links
• Aggregated, anonymized data may be used to improve the App

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App's functionality
• Upload malicious code or content
• Impersonate another person or entity
• Use the App in any way that could harm minors

6. Intellectual Property

6.1 Our Rights

The App, including its content, features, and functionality, is owned by Tiny Sleeps and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to download and use the App for personal, non-commercial purposes in accordance with these Terms.

6.3 Your Content

You retain ownership of the data you enter into the App. By using the App, you grant us a license to store, process, and display your data as necessary to provide the service.

7. Third-Party Services

The App may integrate with third-party services, including:

• Apple Sign In for authentication
• Cloud storage providers for data synchronization

Your use of these services is subject to their respective terms and privacy policies.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS
• WE ARE NOT RESPONSIBLE FOR ANY DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE APP

9. Indemnification

You agree to indemnify and hold harmless Tiny Sleeps and its affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to conflict of law principles.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating formal proceedings, you agree to first contact us at [email protected] to attempt to resolve any dispute informally. We will make reasonable efforts to resolve the matter within 30 days.

12.2 Formal Proceedings

If informal resolution is unsuccessful:

• For users in the European Union: Disputes shall be submitted to the courts of Tallinn, Estonia, which shall have exclusive jurisdiction.
• For users outside the European Union: Disputes shall be resolved through binding arbitration administered by the Arbitration Court at the Estonian Chamber of Commerce and Industry, in accordance with its rules. The arbitration shall take place in Tallinn, Estonia, and be conducted in English.

12.3 Class Action Waiver

To the extent permitted by applicable law, you agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

12.4 EU Consumer Rights

Nothing in this section limits your rights as a consumer under applicable EU consumer protection laws, including your right to bring proceedings in the courts of your country of residence.

14. Apple-Specific Terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and Tiny Sleeps, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims related to the App
• Apple is a third-party beneficiary of these Terms

By using Tiny Sleeps, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
